| dc.description.abstract | Bu tezde 6458 sayılı Yabancılar ve Uluslararası Koruma Kanunu ile düzenlenen sınır dışı etme işlemine ilişkin usul ve esaslar incelenmiştir. Tezin ilk bölümünde sınır dışı etme işleminin hukuki niteliği, ulusal ve uluslararası dayanakları anlatılmıştır. İkinci bölümde Yabancılar ve Uluslararası Koruma Kanunu'nda öngörülen sınır dışı etme uygulaması mahkeme kararları çerçevesinde incelenmiştir. Bölümün sonlarına doğru ise sınır dışı edilmeyi engelleyen sebepler ve sınır dışı etme kararına karşı öngörülen yargı yolları mahkeme kararları çerçevesinde değerlendirilmiştir. | dc.description.ozet | In this thesis, the procedures and principles regarding the deportation process regulated by the Law No. 6458 on Foreigners and International Protection have been examined. In the first chapter of the thesis, the legal nature of the deportation process and its national and international basis have been explained. In the second chapter, the deportation practice stipulated in the Law on Foreigners and International Protection has been examined within the framework of court decisions. Finally, at the end of the chapter, the reasons preventing deportation and the judicial remedies available against the deportation decision have been assessed within the framework of court decisions.
