| dc.description.abstract | Teknolojinin bu denli geliştiği günümüzde insanların özel ve aile hayatlarına başka insanlar ve özellikle devlet tarafından saygı gösterilmesi kritik bir öneme sahipken söz konusu kamu görevlileri olduğunda bu önem bir kat daha artmaktadır. Bu önemin bilincine sahip bir şekilde seçilen tezin amacı; kamu görevlilerinin özel hayatları ve aile hayatları idareyi ne zaman ilgilendirecek, idarenin hangi tür işlemleri kamu görevlilerinin özel hayatlarına ve aile hayatlarına saygı hakkına bir müdahale oluşturacak sorularına cevap aramaktır. Çalışmanın birinci bölümünde özel hayatın tanımı ortaya konmuş, ulaşılamama hakkı ve kamu görevlilerine ahlaki durum sebebiyle uygulanan yaptırımlar incelenerek sorulara cevap aranmıştır. Konular yargı kararlarıyla birlikte ele alınmış, ulaşılamama hakkının özel hayatla ilgisi olması için en azından belli bir asgari ağırlık seviyesine ulaşması gerektiği sonucuna varılmıştır. Ahlaki durum sebebiyle uygulanan yaptırımların özel hayata saygı hakkı kapsamında bulunmasında bir tereddüt olmamakla birlikte görevin icrasına, kurum disiplinine etkisi olmadığı sürece kamu görevlisinin ahlaki durumunun idareyi ilgilendirmemesi gerektiği sonucuna varılmıştır. İkinci bölümde aile hayatının tanımı yapılarak eş durumu mazeretine dayalı atamaların aile hayatına saygı hakkıyla ilişkisi ortaya konmuştur. Eş durumu atamalarının aile hayatına saygı hakkı kapsamında bir menfaati ihlal edip etmediği yargı kararlarıyla incelenmiştir. | tr_TR |
| dc.description.ozet | In today's world where technology has developed so much, it is of critical importance that people's private and family lives are respected by other people and especially by the state, while this importance increases even more when it comes to public officials. The aim of this study, which was chosen with the awareness of this importance; it is to seek answers to the questions of when the private and family lives of public officials will be of interest to the administration, and what kinds of actions of the administration will constitute an interference with the right to respect for private and family life of public officials. In the first part of the study, with the definition of private life, the right to be unreachable and the sanctions applied to public officials due to moral status were examined and answers were sought to the questions. The issues were discussed together with the judicial decisions, and it was concluded that the right not to be reached should reach at least a certain minimum level of weight in order to be related to private life. Although there is no hesitation within the scope of the right to respect for private life, it has been concluded that the moral status of a public official should not concern the administration unless it has an effect on the performance of his duties and the discipline of the institution. In the second part, the definition of family life is made and the relationship between appointments based on spousal status and the right to respect for family life is revealed. Spouse status appointments have been examined by judicial decisions whether they violate an interest within the scope of the right to respect for family life. | tr_TR |
