| dc.description.abstract | Özellikle kamu görevlileri açısından önem taşıyan disiplin kavramı ile kamu hizmeti düzeninin sağlanması amaçlanmaktadır. Bu amaç için yapılan düzenlemelerin ve işlemlerin kamu hizmetinin görülmesini engellememesi gerekir. Bu nedenle düzenlemeler ve işlemler yapılırken ilgili kamu görevlilerinin statüsü ve gördükleri kamu hizmetinin özellikleri dikkate alınmalıdır. Aksi durumda disiplinin amacı ile çelişecek ve kamu hizmetinin gereği gibi yerine getirilmesini engelleyecektir. Anayasa Mahkemesinin son yıllarda vermiş olduğu iptal kararlarının bir neticesi olarak akademik personelin disiplin işleri tamamıyla 2547 sayılı Kanun'da düzenlenmiştir. Yapılan bu düzenlemeler kimi yönüyle genel disiplin rejimine benzemekte kimi yönüyle ise genel disiplin rejiminden ayrılmaktadır. Elbette akademik personelin disiplin rejiminin, akademik personelin kendine özgü statüsü ve özellikle akademik özgürlük kavramının bir gereği olarak birçok yönden genel disiplin rejiminden farklı olması gerekir. Bu sebeplerle akademik personelin disiplin rejimi ile genel disiplin rejiminin karşılaştırılarak değerlendirilmesi mevcut duruma ışık tutması açısından önemlidir. Bu kapsamda çalışmanın ilk bölümünde bazı temel kavramlara, disiplin cezasının hukuki niteliğine ve disiplin rejimlerine ilişkin temel ilkelere değinilmiştir. İkinci bölümde akademik personelin tabi olduğu disiplin suçları ve soruşturma süreci genel disiplin rejimi ile karşılaştırmalı olarak ele alınmıştır. Son bölümde ise disiplin cezalarına karşı başvuru yolları değerlendirilmiş ve başta akademik özgürlük kavramı olmak üzere akademik personelin statüsünün yargısal denetime etkisi tartışılmıştır. | tr_TR |
| dc.description.ozet | It is aimed to ensure the public service order with the concept of discipline, which is particularly important for public officials. Rules and acts made for this purpose mustn't prevent public service from being performed. Therefore, when making rules and acts, the status of the relevant public officials and the characteristics of the public service they perform ought to be taken into account. Otherwise, it contradicts the purpose of the discipline and hinder the proper performance of the public service. As a result of the annulment decisions of the Constitutional Court in recent years, the disciplinary proceedings of the academic staff are utterly regulated in the Law No. 2547. This regulation is similar in some respects to the general disciplinary regime and differs from the general one. Of course, the disciplinary regime for academic staff must differ in many ways from the general disciplinary regime, as this is required by the sui generis status of the academic staff and in particular the concept of academic freedom. For these reasons, it is vital to evaluate by comparing the disciplinary regime of academic staff with the general disciplinary regime so as to shed light on the present situation. In this context, within the first part of the study, some basic concepts, legal characteristics of disciplinary punishment and basic principles regarding disciplinary regimes are referred. In the second part, the disciplinary crimes that academic staff are liable to and disciplinary proceedings are discussed in comparison with the general disciplinary regime. In the last part, the legal remedies against disciplinary penalties were evaluated and the effect of the status of academic staff, particularly the concept of academic freedom, on judicial review was discussed. | tr_TR |
